NRI taxation is a bit tedious as there are less cases that you relate to. Like in one scenario where any Non Resident Indian wants to sell house and is making a loss on the transaction gets worried while researching the details about TDS.

NRI personal experience where he saved the TDS while making capital loss on property sale.

One of my friend recently sold his property in his hometown in Uttar Pradesh. The property was a depreciating asset for him. Lets not talk about the reason, but the important point was that he was selling it for less than how much he purchased that for. Initially he was in dilema if the TDS will be deducted upfront and later needs to be claimed from Income Tax department or if there is any way to avoid paying that money. Here is what he did :

  1. Before making the sale, he applied for form 13 on Income Tax India Website.
  2. To do so, he logged into his Income tax portal
  3. After successful login the steps invole to go to e-File → Income Tax Forms → File Income Tax Forms
  4. Selection of the Section 195 that refers to Lower / Nil TDS on sale of immovable property.
  5. Information related to transaction and Seller / Buyer information is needed, which involves :
    • PAN Card and Residential Status of Seller (NRI in his case)
    • Property type and Address (Residential in his case)
    • Expected sale value.
    • Name and PAN card of buyer.
  6. After this informaiton the following documents should be uploaded :
    • Purchase deed of the property.
    • Indexed cost.
    • Computation of Capital Loss (A simple statement provided by a Chartered accountant increases further scrutiny)
    • ITR (Last Financial Year)
    • Proof of residential status (Passport / Visa / OCI)
    • PAN Card copy.
  7. Submission of the provided information.

It usually takes 2-3 weeks to complete the case you submitted. You will get a TDS certificate which you need to give to the buyer and buyer can legally pay you full amount without holding the TDS.

Important

The submission of form 13 has to be done before selling the property. If you have sold the property then still you can ask for the refund of the TDS amount while filing your Income tax return.

Voting season is on. If you are living outside India but you are still the Indian citizen who is above the age of 18, then you can vote.

The voting process is offline and requires a prior document verification. It is also important to note that every voter has to visit the polling booth where He/She is eligible to vote.

Here is How NRI Can register and Cast their Vote

Signing up as the new Overseas Voter by filling Form 6A

Submit this form online at : https://voterportal.eci.gov.in/

Please ensure that once you submit the form, you are also required to submi the following document :

  • One recent passport size coloured photograph affixed in Form 6A.
  • Self attested photocopies of the relevant pages of the passport containing photograph, address in India and all other
  • The page of passport containing the valid visa endorsement

Submission of the Form :

There are two ways of doing this

  1. Either you do it online or you can submit it via post.
  2. If you are physically present in India, you can fill the form in person at the Electoral Registration Officer / Assistant ERO of the constituency.

Make sure you carry your passport when you are submitting your application personally in India.

Wait for Verification

The polling agent will contact the person / representative at the Indian address you provide in your application. Once the verification step is completed, wait for the polling date in your location.

Cast Your Vote

Keep in mind, you can only vote when you are in India on the date of voting in your electoral constituency. There is no possibility of casting your vote from ourside India. The only provision is to allow the data updation in the Electoral records.

Legal Validity of Indian registered marriage certificate in USA

All Indian Marriage certificates issued by Sub-registrar of Jurisidiction are 100% valid in USA. You can use them anywhere whereever you need it.

It is interesting to know that in order to prove the validity of marriage in USA, you should apply for marriage certificate and not just rely on the proof of marriage as applicable in the all the legal acts. For example, marriage cerimony performed under Hindu Marriage Act / Anant Karaj / Muslim Sharia is legal in India, but you should get marriage certificate from the Magistrate / Sub- Registrar for its international usage.

Law in USA for considering International marriages

As per 7 FAM Exhibit 1454, MARRIAGE OF U.S. CITIZENS ABROAD, any marriage which is legal in country except outside USA will be legal in USA as well.

Interesting Point

If your spouse name is mentioned in your passport, in that case you do not need to carry any separate marriage certificate.
